National Territory & Full Capacity
The provisional permit enables both employed work (contract with a company) and self-employment (registering as self-employed and starting your business) in any economic sector and throughout Spanish territory.
In this regularisation, the right to work is not obtained the moment you submit the application. The actual legal right activates once your application is admitted to processing (a process that usually takes just 15 days after submitting electronically).
You can work and reside freely in any province or city in Spain without geographical restrictions.
You can sign a contract with a company to get registered, or set up as self-employed.
No linked exceptions: hospitality, agriculture, transport, consulting, technology or construction.
Legal note: If the final resolution is favourable, the legal effect of Social Security rights will be backdated to when you submitted the initial application.
Many business owners or HR departments are afraid of being fined for hiring staff 'in processing status'.
The draft legal text requires the Administration to include a legal security clause in your file for the complete peace of mind of your employer.
To demonstrate the legality of the hire or to register with Social Security, you must present the procedure start notification to your company.
The procedure start notification will expressly state that it authorises its holder to work legally.
The official text is clear. Many applicants who do it for free with an NGO start working happily, but months later receive the final denial due to a silly mistake (a wrongly certified document or a weak proof).
Immediate loss of rights
Denial means the automatic and immediate loss of validity of the provisional work authorisation. The right ends at once.
Legal Obligation: You must immediately notify your employer of the denial so they can process your immediate deregistration from Social Security. If you don't, you will both face massive fines.
Your employer will trust you to register. If you submit your file with flaws and get denied, you will immediately lose both the job and the company's trust.
By hiring expert lawyers to defend your Iron File, you guarantee your company that the provisional work authorisation will turn, in a few months, into a firm Residence Card.
