Does the regularisation request suspend the deportation order?
Legal practice and the new law confirm that submitting the request does not erase the order instantly, but its admission to processing (which takes a maximum of 15 days) does protect you. Upon obtaining that provisional legal authorisation, the execution of the order is frozen, as you become documented and protected by the State while your case is resolved.
Exact requirements for the order to be "Revoked" and "Filed"
The Draft Royal Decree (Fifth and Sixth Transitional Provisions, section 6) is clear: granting the authorisation will mean filing and revoking the order. The legal key: the reason for your expulsion must be EXCLUSIVELY administrative:
Art. 53.1.a): Being in Spain without papers (irregular stay).
Art. 53.1.b): Working without a work permit.
If you meet this, the 2026 regularisation approval will erase the order permanently.
Direct exclusion causes and the major police nuance
If the deportation order is NOT due to irregularity, the scenario changes. Know the 3 legal barriers:
1. Bloqueo Fronterizo
Prohibición de Entrada Vigente:If you were expelled and returned crossing the border while your 'penalty' (e.g. 3 to 5 years) is still active, the application will be directly denied (Administrative Exclusion).
2. Condena Jurídica
Expulsión por Delito (Art. 57.2):If the order was issued by a judge instead of a prison sentence (intentional crime > 1 year), you are excluded from the process (Criminal Exclusion).
3. Zona Gris Legal
Police Record vs. Threat to Public Order:
Having been arrested once (without conviction) does not automatically exclude you. And here is the major nuance few know:
⚖️ El recurso exclusivo:Unlike a conviction, Article 130.2 of the Regulation states that a police report does not automatically deny residence. Immigration assesses on a case-by-case basis whether you pose a real threat. Free NGOs cannot draft legal arguments to save this point; we can.
